After 22 years of service as a traffic police constable Jitendra Raghunath Hindule (41) was transferred to the Local Arms (LA) department of the Maharashtra police because his seniors believed he was effete and therefore belonged to the 'third gender'.

The 'proof'

In the bizarre one-page note, (a copy of which is with MiD DAY), dated July 5, 2008, addressed to the then police commissioner Hassan Gafoor, deputy commissioner of Police (traffic) Harish Baijal, writes in Marathi, 'Jitendra Raghunath Hindule's behaviour has been found objectionable.


... Hindule has long hair worn as a plait, which he keeps hidden under his cap. He wears earrings and claps his hand, cusses and behaves like a woman. He is married to Sajid Bootwalla and has embraced Islam'.



Along with Hindule, 40 other traffic cops were also given transfer orders.

Hindule then went on sick leave and all of them approached the Maharashtra Administrative Tribunal for redressal, calling the orders unconstitutional.

Why it's unfair

The transfers mean the cops will lose their seniority. In fact, the LA is considered to be a punishment posting, as it deals with anti terror activities, without any incremental salary.

Some cops were transferred in less than three years, which is not permissible according to the Bombay Police Act 1951.

'It's not legal'

Said Hindule's advocate Anil Joshi, "The transfer is not legal. How can some senior officer suddenly declare my client is a eunuch? He has not been subjected to a medical test."

However, according to an affidavit filed by the government, all the 41 cops were transferred as part of an ongoing cleansing drive.

It said there was rampant corruption in the traffic department and no less than 3,000 cops needed to be transferred.

Hindule was not available for comment.

The Other Side

Refusing to elaborate on the matter, Joint Commissioner of Police (traffic) Sanjay Barve said, "It's a very personal matter, but we have taken a decision afteru00a0 inquiry."
